Below is what the federal rule says, what it means when you buy, and how age checks work when you order from us. What is the legal age to buy a vape in the U.S.?
21. According to the FDA, on December 20, 2019, the President signed legislation amending the Federal Food, Drug, and Cosmetic Act that raised the federal minimum age of sale for tobacco products from 18 to 21. The FDA says the law, known as “Tobacco 21” or “T21,” became effective immediately and that it’s illegal for a retailer to sell any tobacco product, including e-cigarettes, to anyone under 21.
Vapes, disposables, pods and nicotine e-liquids all count. The FDA also notes that the federal minimum age applies to all retail establishments and persons, with no exceptions.
Is the vaping age 18 in some states?
Not for buying. Before 2019, many states set the age at 18 or 19. The federal law now sets 21 as the minimum everywhere in the U.S., so a state can’t sell to 18-year-olds under federal law. States and cities can, and many do, add their own tobacco and vape rules, such as licensing, flavor restrictions or local penalties. Those vary, so check the rules where you live. Do you need an ID to buy a vape?
Usually, yes. The FDA’s rule requires retailers to check photo ID for anyone under age 30 who tries to buy tobacco products, including at gas stations, convenience stores and vape shops. Under the FDA’s August 2024 final rule, that age-30 ID check applied from September 30, 2024. Many stores simply check everyone. Bring a valid government photo ID.
Is it illegal to vape under 21?
The federal Tobacco 21 law is aimed at sales: it makes it illegal for retailers to sell to anyone under 21. Rules about possession or use by people under 21 are set by states and localities and differ from place to place. Either way, you need to be 21 to buy, and we only sell to adults 21+.
How does age verification work at Smokey Cloudz?

- When you enter the site, you confirm you’re 21 or older before you can browse. That’s only a first step, not verification.
- At checkout, we verify your age and identity electronically using the name, address and date of birth you enter, through a third-party age-verification provider. In most cases it takes seconds.
- If we can’t verify you automatically, we may ask for a photo of a valid government-issued ID, such as a driver’s license, state ID or passport. Your order won’t ship until you’re verified.
- At delivery, an adult 21+ must sign for the package and may need to show ID to the carrier.
The name and billing details must belong to the person ordering, and the shipping recipient must also be 21 or older. Buying for, giving to or reselling to anyone under 21 is prohibited.
