Welcome to Smokey Cloudz. These Terms of Service (“Terms”) govern your use of https://smokeycloudz.com (the “Site”) and any purchase you make from Smokey Cloudz (“Smokey Cloudz,” “we,” “us,” or “our”), located at 9016 E 46th Street, Tulsa, OK 74145, United States. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Age Requirement (21+)

The products on this Site contain nicotine and are for adults 21 years of age or older only. Federal law prohibits selling tobacco and nicotine products, including electronic nicotine delivery systems (ENDS), to anyone under 21. By using the Site, you confirm that you are at least 21 and are legally allowed to buy these products where you live. We verify age as described in our Age Policy. We may cancel any order that cannot be age-verified, and we may require an adult (21+) signature with ID at delivery.

2. Nicotine Warning

WARNING: This product contains nicotine. Nicotine is an addictive chemical. Our products are not intended for use by minors, by anyone who is pregnant or breastfeeding, or by anyone who has, or is at risk of, heart disease, high blood pressure, diabetes, or who takes medication for depression or asthma. 3. Who We Sell To: Retail and Wholesale

We sell both directly to adult consumers (retail) and to licensed businesses (wholesale/B2B), including retailers, smoke and vape shops, convenience stores, dealers, and distributors.

• Retail customers buy for personal use at the prices listed on the Site.
• Wholesale/B2B customers must apply for a wholesale account. To qualify, you need to provide your business name, address, and contact person, a copy of your valid state tobacco/vapor license or permit and sales tax/resale certificate where your state requires one a valid state tobacco/vapor retail license or permit and a sales tax/resale certificate where required, and any other information needed to meet applicable law. We may approve, decline, or close a wholesale account at our discretion. Wholesale pricing, minimum order quantities, and payment terms are given on request or in your wholesale account as quoted in your wholesale account. To apply, email info@smokeycloudz.com with the subject “Wholesale Application” or use our wholesale form /wholesale/.
• Wholesale buyers who resell our products are responsible for following all federal, state, and local laws that apply to them, including licensing, age verification at the point of sale, product authorization or registry rules, flavor restrictions, taxes, and labeling.

4. Products, Authenticity, and Availability

We sell authentic products from brands such as Geek Bar, RAZ, and Foger. Product images and descriptions are provided for reference. Packaging, colors, and flavor names can change from the manufacturer. Puff counts and battery life are manufacturer estimates and depend on how the device is used. Products and flavors may not be available in every state or locality, and we may limit or refuse sales to certain locations to comply with the law jurisdictions where sales are restricted by law — contact us if unsure.

5. Orders, Order Limits, and Cancellations

• Placing an order is an offer to buy. We accept it when we ship the order or confirm it in writing.
• We may limit quantities or cancel orders to prevent fraud, unauthorized resale to minors, or illegal shipments, or when an order can’t be age-verified, shows signs of payment fraud, or would break a law. These limits do not prohibit legitimate wholesale or reseller purchases. Large-volume buyers should order through a wholesale account.
• If we cancel an order after you have paid, we will refund you in full to your original payment method.
• If you want to cancel, contact us right away. Orders that have already shipped follow our Refund & Returns Policy.

6. Pricing, Taxes, and Payment

Prices are in U.S. dollars and can change without notice. We do our best to keep pricing accurate. If an item is listed at the wrong price, we may cancel the order or contact you before we process it. Applicable sales, excise, and tobacco/vapor taxes are added as required by federal, state, and local law. Payment is processed securely through our checkout payment provider(s) the payment methods shown at checkout. We do not store full card numbers on our servers.

7. Shipping

Shipping times, carriers, and restrictions are described in our Shipping Policy. Nicotine and ENDS shipments are subject to federal law, including the Prevent All Cigarette Trafficking (PACT) Act, and to state law, so some destinations may be restricted.

8. Returns and Refunds

Returns and refunds follow our Refund & Returns Policy. In short: sealed, unused products may be returned within 15 days of delivery. For health and safety reasons, opened or used nicotine products cannot be returned unless they are defective.

9. Accounts

You are responsible for keeping your account login secure and for all activity under your account. The information you give us, including your date of birth and identity details, must be accurate. We may suspend or close accounts that give false information or break these Terms.

10. Acceptable Use

You agree not to use the Site to break any law; to give false age or identity information; to buy for or supply products to anyone under 21; to interfere with the Site’s security or operation; or to copy or scrape Site content without our written permission.

11. Intellectual Property

All Site content, including text, graphics, logos, and layout, belongs to Smokey Cloudz or its licensors. Brand names such as Geek Bar, RAZ, and Foger are trademarks of their respective owners and are used only to identify the products.

12. Disclaimer of Warranties

Except for any manufacturer warranty or as stated in our Refund & Returns Policy, the Site and products are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Product warranties, if any, come from the manufacturer.

13. Limitation of Liability

To the fullest extent the law allows, Smokey Cloudz is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products. Our total liability for any claim is limited to the amount you paid for the product involved. Some states do not allow these limits, so they may not apply to you.

14. Indemnification

You agree to defend and hold harmless Smokey Cloudz from claims that arise from your breach of these Terms, your misuse of products, or (for wholesale buyers) your resale of products.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Oklahoma, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Tulsa County, Oklahoma, and you consent to their jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date shows the latest version. If you keep using the Site after a change, you accept the updated Terms.
