But since a state law created the ATC VAPE Directory, only vape products listed on that directory may be sold, offered for sale, or possessed for sale in Louisiana. How the Louisiana directory works

• Under Act 414 (2023), manufacturers whose vapor products are sold in Louisiana must certify each product to the Office of Alcohol and Tobacco Control (ATC). Certified products are posted on the ATC VAPE Directory, updated monthly. (La. ATC)
• To be listed, a product generally must have an FDA marketing authorization, or a premarket application (PMTA) filed by Sept 9, 2020 for a product on the market as of Aug 8, 2016 that’s still under FDA review or under a stayed/appealed denial. (La. R.S. 26:926.1)
• The Louisiana Department of Revenue tells retailers: products not listed “may not be sold, offered for sale, or possessed for sale in Louisiana.”

Act 274 of 2025 (HB 412) amended the directory law (R.S. 26:926.1 and related sections) for vapor and alternative nicotine products, effective August 1, 2025.
